Art. 27.14. PLEA OF GUILTY OR NOLO CONTENDERE IN MISDEMEANOR

When a person simply goes down to Hurst Municipal Court ot pay off a traffic ticket most do not realize that the offense will now go down on their permanent driving record.  The payment of a fine with nothing more is controlled by Article 27.14 of the code of criminal procedure.  The controlling section states the following:

  • In a misdemeanor case for which the maximum possible punishment is by fine only, payment of a fine or an amount accepted by the court constitutes a finding of guilty in open court as though a plea of nolo contendere had been entered by the defendant and constitutes a waiver of a jury trial in writing.

An entry of a guilty plea in Hurst Municipal Court requires the court to report the violation as a conviction to Texas DPS.  Once DPS is informed of the conviction, they then do their own damage.  DPS can assess penalties as severe as suspending a person’s driver’s license and as financially crippling as requiring a driver to pay $260.00 per violation per year for each reported offense.  The financial penalties are assessed for at least a 3 year period and are unlimited in the amount you will have to pay.
